1.1. This Privacy Policy describes how Omnyx Corporation ("we", "us", "our", "Company") collects, processes, stores and protects user ("User", "you" or "your") data when accessing and using Omnyx Wallet through the mobile application, website, and other interfaces provided by us (the "Platform").
1.2. Omnyx Wallet is a non-custodial wallet application. The Company does not store or have access to your Seed Phrase or private keys and does not custody Digital Assets. Digital Assets are recorded on Blockchain Networks and can be controlled only by the person who holds the corresponding private keys, which are stored on your device.
1.3. By accessing or otherwise using the Platform operated by Omnyx Corporation, a company registered under the laws of the British Virgin Islands (registration number 2184082, registered office: Intershore Chambers, Road Town, Tortola, British Virgin Islands), you acknowledge that you have read and understood this Privacy Policy and the purposes and methods of data collection and processing described herein.
1.4. The Company is aware of the importance of privacy and is committed to protecting your data. This Privacy Policy explains:
1.4.1. What data do we collect and why;
1.4.2. How we process and store data;
1.4.3. Your rights regarding the collected data;
1.4.4. In what cases and with whom we can share data.
1.5. If you do not agree to any of the terms set out in this document, please stop using the Platform.
2.1. For the purposes of applicable data protection laws, Omnyx Corporation is the "controller" of personal data processed under this Policy. If you have questions about this Policy or our privacy practices, you can contact us as described in Section 16 (Contact Information).
3.1.1. We follow the principle of data minimization. Use of the Platform does not require you to provide your name, phone number, payment details, or other direct identification data. We do not collect or store your Seed Phrase or private keys. However, as described below, we may process limited technical and usage data and information that you voluntarily provide to us. To enable access to Blockchain Networks, the Platform may transmit public blockchain identifiers (such as Wallet addresses and Transaction data) to Blockchain Networks and RPC access providers. The Company does not store such blockchain data on its own servers as a User profile and does not seek to link it to your real-world identity.
3.1.2. When using the Platform, limited technical and usage data may be processed by the Company or locally on your device, including:
3.1.2.1. Platform type: a constant value identifying the interface (for example, "ios"), transmitted with API requests.
3.1.2.2. Local processing of User settings: wallet name, selected colour theme, and display options for the Digital Asset list (such as hiding small balances, showing exchange rates, showing exchange rates for stablecoins, and grouping Digital Assets by Blockchain Network) are stored on your device and are not transmitted to the Company.
3.1.2.3. Wallet account record: when a Wallet is created or imported, the Platform generates two public identifiers (a Wallet identifier and a device identifier) and a verification value derived from your PIN code, and transmits them to the Company's servers, where they are stored as an account record and used to authenticate subsequent requests from the application. These identifiers are cryptographic public keys derived on your device. They are not linked to your name or to any other direct identification data, and they are not used to track you across applications or websites.
3.1.2.4. Encrypted asset settings: the list of Digital Assets you have chosen to display is stored on the Company's servers as an encrypted document so that it remains available when you use the same Wallet on another device. The encryption key is derived on your device from your Seed Phrase or, where the Wallet was imported using a Private Key, from that Private Key, and is never transmitted to the Company, which therefore cannot read the contents of this document.
3.2.1. Support communications: if you contact us (e.g., by email), we will receive the content of your message and any information you choose to provide, such as your email address and device details for troubleshooting.
3.2.2. Feedback and surveys: if you respond to surveys or provide feedback, we will process the information you submit.
3.3.1. We receive data in the following ways:
3.3.1.1. App stores and operating systems: Apple (App Store) and Google (Google Play), as well as the mobile operating system provider, may process certain data in connection with installing, updating, and running the Platform. Such processing is governed by their own privacy policies and is outside the Company's control.
3.3.1.2. Data provided by the User locally: wallet name, selected colour theme, and display options for the Digital Asset list. This data is stored exclusively on the User's device and is not transmitted to us.
3.3.1.3. Access to Blockchain Networks: The Platform uses RPC and similar infrastructure providers to request blockchain data, retrieve token information, and submit Transactions to Blockchain Networks, including transfers and smart-contract interactions initiated by the User. Such requests may include public blockchain identifiers (for example, Wallet addresses, smart-contract addresses, and Transaction data) and are limited to what is necessary for the Platform to function. Depending on the provider and connection method, the provider may also receive an IP address and similar technical connection data. These providers process information under their own terms and privacy policies, and the Company does not control their independent processing activities.
3.4.1. To enable access to Blockchain Networks, the Platform must transmit and receive publicly-available blockchain data. This may include wallet addresses, transaction hashes, token contract addresses, and transaction metadata. Blockchain data is generally public by design, may be stored on distributed ledgers, and may be accessible to anyone.
3.4.2. We do not store your blockchain transaction history on our own servers as a user profile and we do not attempt to link your on-chain activity to your real-world identity. Nonetheless, wallet addresses and on-chain activity may be linkable to an individual by third parties (for example, through public records, analytics, or other data sources).
3.5. Locally Stored Information on Your Device. Some information is stored locally on your device and is not transmitted to us. This may include Wallet names, the selected colour theme, and display options for the Digital Asset list. Local storage may also include encrypted Wallet data managed through your device security features.
4.1. The Platform may rely on independent Third-Party Services, including RPC providers, blockchain explorers, indexers, token metadata providers, pricing data providers, and technical services used to facilitate smart-contract interactions. These providers may process requests, public blockchain identifiers, Transaction data, IP addresses, and other technical data necessary to provide their services in accordance with their own privacy policies and terms.
4.2. The Company does not control the independent processing activities of Third-Party Services and does not provide your Seed Phrase or private keys to them. You are responsible for reviewing the privacy policies and terms of the relevant Third-Party Services.
5.1. The data collected is used exclusively to ensure the stable operation, security, and continuous improvement of the Platform's functionality.
5.2. The collected information is processed strictly for the following purposes:
5.2.1. Technical support and platform development: identifying and resolving errors, assisting Users in troubleshooting, enhancing the stability and performance of the application, and optimizing its overall operation.
5.2.2. Local preservation of User preferences: processing Wallet name, colour theme, and display options for the Digital Asset list.
5.2.3. Responding to support requests and communication: addressing your inquiries and providing assistance.
5.2.4. Compliance with legal obligations: ensuring adherence to applicable laws and regulations.
5.3. Except for information you voluntarily provide to us, information collected automatically is limited to technical and usage data and public blockchain identifiers necessary to operate, secure, and improve the Platform. We do not sell personal data and do not share it for cross-context behavioral advertising or targeted advertising, as those terms are defined under applicable U.S. state privacy laws.
6.1. If you are located in the European Economic Area (EEA), the United Kingdom, or another jurisdiction requiring a lawful basis for processing personal data, we rely on one or more of the following legal bases depending on the context:
6.2. Performance of a contract: processing necessary to provide the Platform and the related functionality you request in accordance with the Terms of Use of the Platform.
6.3. Legitimate interests: processing necessary for our legitimate interests, such as securing and improving the Platform, preventing abuse, and operating our business, where such interests are not overridden by your rights.
6.4. Consent: where required, we will process certain data based on your consent (for example, marketing communications). You may withdraw consent at any time.
6.5. Legal obligation: processing necessary to comply with applicable laws, lawful requests, and regulatory requirements.
7.1. The Company does not store or have access to Users' Seed Phrases or private keys. Wallet data and settings identified in Section 3.5 are stored locally on the User's device and remain under the User's control. The Company may retain only the limited categories of information described in this Privacy Policy, such as support communications, feedback, and the Wallet account record and encrypted asset settings described above.
7.2. The Company may process support communications, feedback, and other limited information described in Section 3. Technical and usage data may not directly identify a User, but may constitute personal data under applicable law if it can reasonably be linked to a particular device or individual.
7.3. Seed Phrases, private keys, and locally stored Wallet settings are not transmitted to the Company. Public blockchain identifiers and limited technical data may, however, be transmitted to Blockchain Networks and Third-Party Services as described in Sections 3 and 4. Users remain responsible for applying appropriate measures to safeguard their devices, authentication credentials, Seed Phrases, private keys, and locally stored data.
7.4. We implement reasonable administrative, technical, and organizational measures designed to protect the information we process. However, no system is completely secure. You are responsible for safeguarding your device, using appropriate device security controls, and protecting your private keys.
7.5. Because Omnyx Wallet is non-custodial, we cannot recover your private keys, freeze your Digital Assets, or reverse Blockchain Transactions. If your private keys are compromised, you may lose access to your Digital Assets.
7.6. To enhance security, the Platform enables Users to apply additional protection methods on their devices, including, but not limited to:
7.6.1. Setting a PIN code;
7.6.2. Biometric authentication (fingerprint, Face ID).
7.6.3. Authentication credentials and biometric templates used for such security controls are processed locally by the Platform, the device, or the operating system and are not transmitted to the Company.
8.1. The website component of the Platform may use technical cookies and similar technologies solely to ensure proper operation and preserve User preferences.
8.2. Technical cookies and similar technologies may process browser or device identifiers and locally stored preferences. They are not used by the Company for targeted advertising. You can control cookies through your device and browser settings. If you reset application data or uninstall the Platform, locally stored settings and preferences may be removed from your device.
8.3. Some browsers offer a "Do Not Track" (DNT) signal. At this time, there is no industry-standard mechanism for honoring DNT signals across services, and our Platform may not respond to such signals.
9.1. We retain information only for as long as reasonably necessary to fulfill the purposes described in this Policy, unless a longer retention period is required or permitted by law. In general:
9.1.1. Wallet account records and encrypted asset settings are retained for as long as the corresponding Wallet exists and are deleted when the User deletes that Wallet through the Platform. If all Wallets are instead removed from a device because the limit of consecutive incorrect PIN entries was exceeded, the record of that device, including its device identifier and PIN verification value, is deleted, while the Wallet identifier, the encrypted asset settings and the records of any other devices on which the same Wallet is registered are retained. Their deletion can be initiated from any other device on which that Wallet is still registered, or after the Wallet has been imported to a device again.
9.1.2. Support communications are retained as needed to address your request and for reasonable follow-up and recordkeeping.
9.2. We may retain certain information for longer where needed to comply with legal obligations, resolve disputes, and enforce our agreements.
10.1.1. EEA/UK: Depending on your location and applicable law, you may have rights regarding your personal data, including the right to request access, correction, deletion, restriction, portability, and to object to certain processing. You may also withdraw consent where processing is based on consent. You also have the right to lodge a complaint with your local data protection authority (for example, in the EEA or the UK) if you believe our processing of your personal data violates applicable law.
10.1.2. U.S. State Privacy Rights: If you reside in a U.S. state that grants privacy rights, you may have the right to know, access, correct, or delete certain personal information and to opt out of certain types of processing, such as sale or sharing for targeted advertising. We do not sell personal data or share it for targeted advertising as described in this Privacy Policy.
10.1.3. Because the Company processes only limited categories of personal data, certain rights may apply only to information that the Company maintains and can reasonably verify as relating to you. We may be unable to fulfill a request where we cannot identify the relevant data or verify the requesting person, subject to applicable law.
10.1.4. Users retain full control over their data because:
10.1.4.1. Seed Phrases, private keys, and certain Wallet settings are stored exclusively on the User's device;
10.1.4.2. The Platform provides a built-in Wallet deletion function. Deleting a primary Wallet erases it from the device and instructs the Company to delete the corresponding account record from its servers, including the Wallet and device identifiers, the PIN verification value, and the encrypted asset settings. No separate request to the Company is required, and the deletion takes effect immediately;
10.1.4.3. If you delete the application or reset its data, locally stored information may be deleted from the device; however, this does not delete information recorded on Blockchain Networks or information independently retained by Third-Party Services;
10.1.4.4. The User can independently delete or change locally stored data at any time.
10.2.1. We do not engage in automated decision-making or profiling that produces legal or similarly significant effects about you based solely on automated processing.
11.1. The Platform is not intended for use by individuals under the age of 18 (or the age of majority in your jurisdiction). We do not knowingly collect personal data from children. If you believe a child has provided personal data to us, contact us and we will take appropriate steps to address the issue.
12.1. The Company reserves the right to update or amend this Privacy Policy at any time in order to reflect changes in legal requirements, our data processing practices, or improvements to the Platform.
12.2. Users are solely responsible for regularly reviewing this Privacy Policy to remain informed of any updates or modifications. The Company does not provide individual notifications of such changes.
12.3. All changes take effect upon publication of the updated version on the Platform, unless otherwise stated. Continued use of the Platform following such changes constitutes acknowledgment of the revised Privacy Policy.
13.1. We may process information in countries other than your country of residence. Where required by applicable law, we implement appropriate safeguards for international transfers, such as contractual protections or other lawful transfer mechanisms.
14.1. This Privacy Policy shall be governed by, and construed in accordance with, the laws of the British Virgin Islands, without regard to conflict of law provisions.
15.1. In the event of any dispute, claim, or disagreement arising out of or in connection with this Privacy Policy, the parties shall first endeavor to resolve the matter amicably through negotiations.
15.2. If the dispute cannot be resolved through negotiations, it shall be submitted to the competent courts of the British Virgin Islands for final resolution, unless otherwise required by applicable law.
